1. Who we are and acceptance
BATT is an app offered by Hugo Nieto Martínez, Tax ID (NIF) 54396592M, based in Boadilla del Monte, email shnietomar@outlook.com. By downloading or using BATT you accept these terms and the Privacy Policy. If you don’t agree, don’t use the app.
2. What BATT is
BATT blocks the apps you choose and lets you unlock time by doing physical activity. Today it counts steps and activity through Apple Health. Later on it will be able to detect exercises with the camera and connect to other fitness apps. It includes streaks, statistics, friends, leaderboards, challenges and invitations.
3. Requirements
- Be at least 16 years old. By using BATT you confirm that you are.
- A compatible iPhone, with Health and Screen Time permissions turned on for the features that need them.
- Give truthful information when you create your account and keep your login private. You are responsible for whatever is done with your account.
4. Health and physical activity notice
- BATT is not a medical device or a medical or psychological treatment, including for phone addiction.
- Exercise according to your fitness level. If you have a medical condition, consult a professional before using BATT.
- Leaderboards, challenges and streaks don’t oblige you to push past your limits. You are responsible for exercising in a safe environment.
- Step and activity data depend on Apple Health and your device and may not be accurate.
5. App blocking
Blocking works through Apple’s Screen Time API. It may fail because of iOS changes, device settings or other causes outside BATT’s control. You can turn blocking off at any time from the app or from iOS settings. Don’t rely on BATT to block or allow apps you may need in an emergency.
6. Social features and your content
- What’s yours: the videos, photos and text you upload (“your content”) remain yours.
- The permission you give us: a free, non-exclusive, worldwide license to host, display and transmit your content only so that BATT works, for example to show your challenge video to the person you challenge. The license ends when you delete the content or it expires.
- Your responsibility: you may only upload content you have the rights to. If another person appears in it, you need their permission.
- Not allowed: illegal, sexual, violent, hateful or harassing content, or content that impersonates someone else.
- Removal: we may remove content that breaks these terms and suspend the account that posted it. You can report content by writing to BATT.
7. Invite program
- When someone subscribes with your code, you both get a discount, under the conditions shown in the app at the time.
- Inviting yourself, creating fake accounts or spamming is not allowed. If we detect fraud, we may cancel the rewards.
- We may change or end the program with notice in the app; rewards already earned will be honored.
8. Subscriptions (once available)
- BATT is free for now. When a Premium subscription is available, it will be purchased in the app through the App Store and charged by Apple.
- The subscription renews automatically at the end of each period unless you cancel it at least 24 hours before, from Settings > [your name] > Subscriptions.
- If you cancel, you keep Premium until the end of the paid period.
- If there is a free trial and you don’t cancel before it ends, the first period will be charged.
- Prices are shown in the app before you pay. If they change, Apple will notify you before the renewal.
- Refunds are handled by Apple at reportaproblem.apple.com. Nothing in these terms limits your statutory rights as a consumer, including the right of withdrawal where applicable.
9. Prohibited use
You may not:
- Copy, modify, decompile or reverse engineer BATT.
- Tamper with activity counting or get around blocking with cheats, scripts or fake devices.
- Harass, threaten or deceive other users.
- Use BATT for illegal purposes or in ways that harm the service.
10. Intellectual property
The app, brand, name, logo, designs and code belong to Hugo Nieto Martínez or its licensors. We give you a personal, non-exclusive, non-transferable permission to use BATT on your Apple devices under these terms.
11. Changes to and availability of the service
We may add, change or remove features, and the app may have interruptions or errors. If a change significantly harms you and you have a paid subscription, we’ll let you know in advance.
12. Liability
BATT is provided as is, to the extent permitted by law. We are not liable for indirect damages, loss of data or loss of profits arising from the use of the app. This does not limit our liability for willful misconduct, gross negligence, or harm to life or health, nor any right the law grants you as a consumer.
13. Suspension and account closure
You can stop using BATT and delete your account whenever you want from Settings. We may suspend or close your account if you break these terms, with notice unless the law or security prevents it.
14. Apple-related terms
- These terms are between you and Hugo Nieto Martínez, not Apple. Apple is not responsible for BATT or its content.
- Apple has no obligation to provide maintenance or support for BATT.
- If BATT fails to meet an applicable warranty, you can notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation.
- Apple is not responsible for addressing claims relating to BATT, including third-party intellectual property claims.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
15. Changes to these terms
If we change anything important, we’ll let you know in the app or by email at least 15 days in advance. If you keep using BATT afterwards, you accept the new terms.
16. Governing law and courts
These terms are governed by Spanish law. If you are a consumer, you can bring a claim before the courts where you live. Before going to court, write to us at shnietomar@outlook.com and we’ll try to resolve it.
